KANONSKO-PRAVNI KORIJENI SALONITANSKE CRKVE I KULTURE

Sažetak

Rad donosi poglede na pravni vid uspostave salonitanske Crkve, odnosno njezina pravnoga ustroja kao modela funkcioniranja. Povijest ove pravne strukture do izražaja posebice dolazi na njezinu vrhuncu, točnije odnosu salonitanskih biskupa (već uspostavljene i dobrano funkcionalne crkvene strukture) s rimskim biskupom. Pritom se pak crkveno-pravne institucije u oblikovanju partikularne kulture promatraju s istoga stajališta u dvostrukomu (povijesnom) vidu. Prvi vid uzima primjere biskupâ Sinferija, Hezihija, Petra i dr. u njihovu pozitivnom suodnosu s rimskim biskupom te okuplja, analizira i prepoznaje različite crkveno-pravne institucije proizišle iz toga. Drugi pak vid promatra one salonitanske biskupe kao što su Natal , Makism i dr. koji su svojim neprimjerenim i nedoličnim ponašanjem narušavajući odnos s rimskim biskupom (Grgurom I.) izazvali reakcije u vidu restrikcija, zabrana i kazni, a koje se u svojoj sveukupnosti također promatraju u crkveno-pravnom povijesnom ključu. Štoviše, ovakvo očitavanje odnosâ unutar crkvene hijerarhije osim što pridonosi objektivnosti povijesne slike, daje u crkveno-pravnomu povijesnom ključu priliku za izdvajanje svih elemenata, pozitivnih i negativnih, koji su izgradili partikularnu crkveno-pravnu povijest. Poseban dio priloga, a kojim se u potpunosti i konačnici sagledavaju ovi crkveno-pravni povijesni odnosi salonitanskih biskupa s rimskim prvosvećenikom, obrađen je kroz prikaz njihove uloge u crkvenomu raskolu pod nazivom Tri poglavlja (Schisma trium capitulorum). Zaključujući sagledavanje povijesti salonitanske crkve u crkveno-pravnomu ključu u prilogu se u konačnici tematiziraju sinode partikularne salonitanske Crkve, odnosno pokrajinski sabori, čiji pak zaključci u sveukupnosti svojih tema, hijerarhijskoga ustroja, unutarcrkvenih hijerarhijskih odnosâ, pitanja đakona i nadđakona, upravljanja i raspolaganja crkvenim dobrima i dr. istodobno služe kao predmet proučavanja priloga i nagovještaj razvijanja teme u budućim radovima.

VLADIMIR SMOLJO (Split, 1994.) svećenik je Splitsko-makarske nadbiskupije. Godine 2019. diplomirao je na Katoličkom bogoslovnom fakultetu u Splitu iz kolegija Duhovno bogoslovlje, kod prof. dr. sc. Mladena Parlova na temu Lik i duhovnost svećenika u misli Alojzija Stepinca. Iste godine zaređen je za svećenika Splitsko-makarske nadbiskupije, bio je župni vikar u konkatedralnoj župi sv. Petra u Splitu, a zatim do 2022. župni vikar župe Gospe od Otoka u Solinu. Godine 2022. upućen je na studij kanonskoga prava na Papinskom sveučilištu Santa Croce u Rimu.

CANONICAL LAW ROOTS OF THE SALONITAN CHURCH AND CULTURE

Abstract

The paper presents views on the legal aspect of the establishment of the Salonitan Church, i.e. its legal structure as the model of functioning. The history of this legal structure comes to light especially at its peak, more precisely in the relationships between the Salonitan bishops (bishops of an already established and well-functioning Church structure) and the Roman Bishop. In doing this, the role of ecclesiastical legal institutions in the shaping of an individual culture are observed from the same point of view in a double (historical) view. The first view takes the examples of the bishops Synferius, Hesychius, Peter, etc., in their positive relationships with the Roman Bishop and gathers, analyzes and recognizes the various ecclesiastical and legal institutions derived from it. The other view observes those Salonitan bishops such as Natalis, Maximus, etc., who by their inappropriate behaviour, disrupting the relationship with the Roman bishop (Gregory I), caused reactions in the form of restrictions, prohibitions and punishments, which in their totality are also observed in the ecclesiastical-legal historical key. Moreover, this kind of reading the relations within the church hierarchy, besides contributing to the objectivity of the historical picture, gives in the ecclesiastical-legal historical key the opportunity to single out all the elements, positive and negative, that built a particular ecclesiastical-legal history. A special part of the paper, fully and finally examining these ecclesiastical-legal historical relations between the Salonitan bishops and the Roman High Priest, is processed through the presentation of their role in the church schism called The Three Chapters (Schisma trium capitulorum). Concluding the overview of the history of the Salonitan church in the ecclesiastical-legal key, the paper finally deals with the synods of the individual Salonitan Church, that is, the provincial councils, whose conclusions in the totality of their topics, hierarchical structure, intra-church hierarchical relations, matters of deacons and archdeacons, management and disposal of church goods, etc., simultaneously serve as a subject of study of the paper and a hint of the development of the topic in future works.

VLADIMIR SMOLJO, a priest of the Archdiocese of Split-Makarska, was born in 1994 in Split. In 2019, he graduated from the Catholic Theological Faculty in Split, the course of the Spiritual Theology, mentored by Prof. Mladen Parlov, PhD, on the topic Character and spirituality of priest in the thoughts of Alojzije Stepinac. In the same year, he was ordained a priest of the Archdiocese of Split-Makarska, he was a parish vicar in the co-cathedral parish of St. Peter in Split, and then until 2022 parish vicar of the parish of Our Lady of the Island in Solin. In 2022, he was sent to study canon law at the Santa Croce Pontifical University in Rome.
